the Vendido App mobile application (the "App") and the Vendido service (the "Service").
By using the vendido.eu web site, the Vendido App or establishing an account with Vendido and using the Vendido Service,
you ("user") agree to the following terms and conditions.
These Terms apply to all visitors, users and others who access or use the Service.
About Us
Vendido.eu, and vendido.be and the Vendido mobile application are sites and applications operated by
Digital Solutions BVBA, registered in Belgium, No: BE0466.480.225, whose registered office is at Sparrendreef 27, 1910 Kampenhout,
and trading with respect to this agreement as "Vendido" and "Vendido Classifieds" ("we", "our", "us").
General Terms
This Agreement shall be governed and construed in all respects by the laws of Belgium.
You and Vendido both agree to submit to the exclusive jurisdiction of the Belgian Courts;
Vendido acts as a venue to match buyers and sellers, and as such is not involved in the actual transaction between buyers and sellers
and does not transfer legal ownership of items from the sellers to buyers.
We have no control over the items advertised, or the ability of sellers to sell items or the ability of buyers to pay for items.
We are not responsible for contracts for the supply of goods, services or information formed through Vendido, the Vendido App,
or as a result of visits made to Vendido, between you and other Vendido users.
Any contract or agreement is between the buyer and the seller and is subject to the terms and conditions
which are implied by law or which the buyer and seller agree between themselves or both.
We are not a party to the contract between the seller and buyer nor are we liable under it.
We do not provide any warranties or assurances in relation to the Items you purchase (or attempt to purchase)
from third party sellers through Vendido, or from companies to whose website we have provided a link on Vendido,
and any such warranties and assurances are disclaimed by us absolutely.
This disclaimer does not affect your statutory rights against the third party seller.
You are solely responsible for the information you publish, and Vendido acts as a passive conduit for your online distribution and publication of that information.
Furthermore, in agreeing with these terms and conditions, you also agree with the following:
You acknowledge that you must be 18 years or older to use this site or if you are a Minor you have the prior written consent of your parent or guardian to establish an account.
You acknowledge that you are legally capable of entering into binding contracts in order to establish an account.
You acknowledge that you bear sole responsibility for keeping your password secure.
You agree not to bypass security measures used to prevent or restrict access to parts of the website;
You agree not to take any action that may harm Vendido or the interests or property of its users;
You agree not to use Vendido for any illegal or unauthorized purpose.
You agree not to post any threatening, abusive, defamatory, obscene or indecent material;
You agree not to post any material that could incite violence or hatred;
You agree to comply with all local laws regarding online conduct and acceptable content.
You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links or any other content that you submit, post or display on the Website.
You agree not to post or otherwise communicate any false or misleading material or message of any kind;
You agree not to infringe any third-party right;
You agree not to distribute spam, chain letters, or promote pyramid schemes;
You agree not to engage in the selling or trading of animals;
You agree not to collect information about other users, including email addresses, without their consent;
You agree not to copy, modify, or distribute another user's content without their consent;
You agree not to collect data of any form from vendido without express written permission;
You agree not to copy, modify or distribute rights or content from the website, services, applications or tools or Vendido's copyrights and trademarks;
You agree not to sell any counterfeit items or otherwise infringe the copyright, trademark or other rights of third parties.
You agree not to post, display or communicate advertisements or content destined for marketing.
You acknowledge and agree the Website is a venue and as such is not responsible for the content posted on it.
You agree to use the Website at your own risk.
You acknowledge that, while we make every reasonable attempt, we cannot guarantee an uninterrupted, error-free, or secure access to our service and we do not give any promises or warranties, neither express nor implied, about the operation and availability of our site, App, or service, nor that eventual defects will be corrected.
You acknowledge that we bear no responsibility for deletion or failure to store content of any type, nor for eventual data loss.
In the event that one or more of the stipulations of these terms should be null and void, either because it is in contradiction with local law or because a court strikes it down,
these Terms and Conditions will remain valid and the remaining terms will remain in full effect.
Content
Our Service allows you to post, link, store, share and otherwise make available certain information,
text, graphics, videos, or other material ("Content").
You are responsible for the nature and legality of this content, respecting all other stipulations made in these Terms and Conditions.
Any content you upload to Vendido will be considered non-confidential and non-proprietary.
By Posting Content you grant to us an irrevocable, worldwide, royalty free and sub-licensable licence and right to use, copy, store,
distribute and disclose to third parties any such Post and Content for any purpose via any medium.
We reserve the right at our own discretion, to moderate any postings or Content and we have the right to deny, change or remove any Post or modify any Content, such material does not comply with these Terms or we are notified that it may be offensive, illegal or defamatory.
However, while we have the right, we have no obligation to do so.
Membership
Vendido's membership and services are available only to individuals 18 years or older who can form legally binding contracts under applicable law.
You agree not to create more than one account. You also agree not to transfer or sell your account or User ID, or make you account available to third parties.
We are under no obligation to monitor or record the activity of any Vendido user.
We reserve the right to refuse service to anyone for any reason at any time.
We reserve the right to temporarily or indefinitely suspended members at any time and without prior notice.
We reserve the right to modify or terminate any service for any reason at any time, with or without notice.
You can remove your profile at any time by sending a mail through the contact form requesting to us delete your account. Deleting you account will also remove any private content you have stored in the system.
Purchases
Some services or features on Vendido require payment in full before their use ("paid-service").
The amount payable for such services and features will be clearly indicated.
While membership for individuals is free, membership for professional sellers is not. Professional (firms or individuals) sell items on a regular basis, in a more than occasional manner.
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring basis.
We reserve the right to change our prices on occasion.
Price changes pertaining to features which require a one-off payment or for new recurring payments, shall be indicated on the page where the feature may be purchased.
Price changes pertaining to existing recurring payments (such as but not limited to subscriptions), will be sent to you by email in advance and you will have the opportunity to decline payment.
However, if you decline payment you will not receive the Services to which such payment relates.
We shall not start to provide the paid-service (and are under no obligation to do so) unless such service has been paid for in advance in accordance with these Terms.
Without prejudice to any other right or remedy that we may have, we may cancel or suspend the paid-service until such time as amounts due are paid in full.
We reserve the right to terminate accounts or refuse access to Vendido of user who repeatedly fail to pay in advance for paid-service they have signed up for.
We reserve the right to add or remove services and features (paid or non paid) at any time and without any notification nor justification.
If you wish to purchase any product or service made available through the Service ("Purchase"),
you may be asked to supply certain information relevant to your Purchase including, without limitation, your email address and password.
All prices include Value Added Tax unless otherwise stated.
Unless otherwise stated, all fees are quoted in Euros (EUR).

Dispute Resolution
If a dispute arises between you and Vendido, we ask you to first contact us directly by sending an email to support@vendido.eu or by going to the contact page on the website,
in order to work towards a solution.
We also ask you to report all user-to-user disputes to your local law enforcement, or a certified mediation or arbitration entity.
You acknowledge that if you have a dispute with one or more Vendido users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes.
Breach
Without limiting other rights or remedies set forth in this agreement or as otherwise available by law, we may immediately issue a warning, temporarily suspend, indefinitely suspend or terminate your access to the website in whole or in part: (a) if you breach this agreement; (b) if we are unable to verify or authenticate any information you provide to us, should we elect to engage in such verification; or (c) if we believe in our sole discretion that your actions may cause legal liability for you, other users, us or third parties.
Privacy
We process information about you in accordance with our privacy policy published at privacy.
By using Vendido, you consent to such processing and you warrant that all data provided by you is accurate and true.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
If a revision is material we will try to provide at least fourteen (14) days' notice prior to any new terms taking effect.
What constitutes a material change will be determined at our sole discretion.
